Moratorium on customs checks in Ukraine will be lifted: when border checks are strengthened

According to Taras Melnichuk, representative of the Council of Ministers in the Verkhovna Rada, the moratorium on document checks by customs will apply only to taxpayers located in territories temporarily occupied by the Russian Federation.

After the moratorium on tax inspections is lifted, documented customs inspections can be resumed in Ukraine. This is expected to happen as early as March 1, 2024, at the initiative of the Council of Ministers. Taras Melnichuk, representative of the Council of Ministers of the Verkhovna Rada, said in a statement on the Telegram channel that the government took the relevant decision at its meeting on February 6.

As he noted, the adoption of a bill to lift the moratorium on customs controls is one of the obligations of the Ukrainian authorities to the International Monetary Fund (IMF).

  • restore the powers of customs authorities to carry out documented checks of compliance with legal requirements, including the timeliness, reliability, completeness of assessment and payment of customs duties;
  • Restoration of incomplete document checks (counter-reconciliations) initiated before February 24, 2022 for an unused period;
  • Ensuring the sending (delivery) of transactions (certificates) regarding the results of document checks, reconciliations, objections, tax notifications-decisions for which the delivery method is not regulated, within 60 days from the date of entry into force of the law, was completed before February 24, 2022.

At the same time, it is planned to implement a moratorium on document checks at customs for taxpayers located in regions temporarily occupied by Russia or in war zones. The Council of Ministers also wants to regulate the audit procedure in case the payer changes location.

New type of customs controls

Since January 29, within the scope of the pilot project, post-customs control has been carried out at the Ukrainian border within the framework of verification of the information specified in the customs declaration and the documents submitted. It is stated that customs may request documents that are not submitted for customs clearance, but they contain information that you can check the data specified in the customs declaration.

This type of control applies only to customs declarations whose registration takes place no later than 30 calendar days before the start of such control.

Let us remind you that the Customs Service had previously announced which items could be imported to Ukrainians returning home from abroad. Also on January 31, it was reported in the media that the European Commission (EC) officially proposed extending the elimination of customs duties on agricultural products from Ukraine until 2024.
