‘God-given’: Court acquits man who showed middle finger to neighbor

According to witnesses, Michael Naccache initiated the discussion, insulting and even threatening another man with a hand drill.

Unable to withstand such bullying, Neill Epstein replied “fuck you” and walked away, raising his middle finger at her. On the same day, police teams arrested him for threatening death. But Judge Dennis Galiatsatos observed that “fuck you” was not a sufficient reason to call 911.

The case against Neill Epstein, who was accused of harassing his neighbor, was closed by the court. The judge harshly criticized the neighbors’ behavior, believing that their conflicts were caused by “minor, everyday problems.”

“To be perfectly clear, pointing a finger at someone is not a crime. Throwing the notorious bird is a God-given privileged right that belongs to every purebred Canadian,” the judge said.

Galiatsatos noted that it was not a crime to show someone the middle finger.

Naccache had previously accused Epstein of assaulting his parents in March 2021, when the judge denied the initial charge.
