Republican MPs from House of Representatives they approved on thursday the first federal law of its kind prohibit athletes transgender compete in school sports teams with girls and women.
The measure is a priority for the Republican Party, despite the fact that the bill has no chance of being approved by the Senate and even approved by the Upper House, it has been subject to a presidential veto, as the White House has already warned about.
House Speaker Kevin McCarthy praised the “Women and Girls in Sports Protection Act” after the bill passed by a vote of 219 to 203, following a bipartisan line.
“This is a great day for America, a great day for girls and women, and for fairness in sports,” McCarthy said. “Republicans in the House of Representatives have pledged to engage in sports with American women and girls before the last election. Today we support it,” he added.
House bill prohibit transgender women and girls from playing on sports teams based on their gender identity.
It is also seeking to amend federal law to require “gender be recognized solely on the basis of a person’s reproductive biology and genetics at birth” to determine compliance with Title IX in athletics, according to the text of the law.
Title IX of the 1972 Education Amendments prohibits gender discrimination in educational programs or activities which receive funds from the federal government and apply to schools and other educational institutions.
The bill does not “prohibit schools or institutions from allowing men to train against women’s sports teams,” according to a fact sheet from the House Committee on Education and Workforce.
The fact sheet also states that under the bill, “a recipient of federal education funds violates the Title IX prohibition on sex discrimination if the recipient operates, sponsors, or facilitates a sports program or activity and allows a male person to participate in a sports activity, program, or event intended for women or girls.”
Republicans argued that transgender women have a physical advantage over cisgender women in sports and therefore your participation may limit the opportunities of others.
Democrats say policy bans transgender athletes from participating in team sports add to the discrimination faced by trans people, especially trans youth. And they argue that Republicans are seeking to undermine the rights of LGBTQIA students by pushing the bill.
