ex-president Donald Trump Asks Judge Lewis Kaplan to Drop His Trial at the request of the journalist and writer E. Jean Carroll.
Through his attorney, Joe Tacopin, Former president asks judge to ‘fix’ the way evidence and evidence is presented against him or let the defense better cross-examine Carroll and his witnesses.
If he does not agree with the above, Takopina asks the judge to dismiss the lawsuit against the former president, which is taking place in the court of the Southern District of New York.
In a letter to the judge Tacopina lists several reasons why the decision should be inappropriate, including misinterpretation of evidence in favor of the plaintiff; corroborate the testimony of the accuser; pointing the finger at the judge for resolving the plaintiff’s ongoing objections, even if they are a valid cross-examination tactic.
Also for allowing Natasha Steinoff’s testimony without prior scrutiny, in addition to accusing Judge Kaplan of putting Trump’s lawyer under special pressure when he mentions a violation during the trial.
“As stated above, I ask the Judge to conduct a mistrial or, alternatively, (1) correct the record of each of the cases in which the Court misrepresented the facts of this case before the jury, and (2) allow the defendant’s lawyer to better cross-examine the defendant, and her witnesses,” Tacopina said in a letter.
Trump’s lawyer gives several examples of his complaints, including when Judge Kaplan intervened to point to Carroll’s book titled Why Do We Need Men? A modest offer,” he was referring to the well-known satire by Jonathan Swift.
For lawyer Tacopina, this comment by Judge Kaplan suggests “jury favoritism” as well as other actions of the judge in favor of the plaintiff.
Trump sued Carroll in 2022 for defamation and damages after the former president dismissed rape allegations made by a journalist on his Truth Social platform.
