The Chernigov Desnyansky District Court ruled that the local Pension Fund is obliged to pay the pensioner moral compensation in the amount of 2 thousand hryvnias. It is worth noting that the plaintiff initially demanded payment to him in the amount of 20 thousand hryvnias, but the court decided to reduce this amount by 10 times. This situation is stated in the court decision regarding case no. 750/12635/23.
Before this, the pensioner had already won a victory in court, forcing the authorities to review the amount of the payment.
In the decision of the Chernigov Regional Administrative Court dated June 6, 2023, numbered 620/1924/23, the court accepted his request. The court also declared illegal the actions of the Main Directorate of the Pension Fund of Ukraine in the Chernihiv region regarding the unlawful refusal to accrue and pay additional pension payments.
According to the information obtained, the additional payment amount for the period between July 2021 and July 2023 was 33.5 thousand hryvnia. However, despite the court order, the local Pension Fund never paid this amount. Perhaps there are no funds in the budget to compensate for the losses caused by the defeat in court.
“The plaintiff submitted an application for consideration of the case without his participation. The defendant’s representative did not attend the hearing, he was informed about the time and place where the case would be considered in the manner prescribed by law and did not provide reasons for the court’s failure to come,” the court says in its decision.
