The Pension Fund announced that people who have completed work experience in harmful and dangerous sectors can retire under preferential conditions after 50 years.
Even though there is a war in Ukraine, pensions continue to be granted and paid to its citizens. Some categories of Ukrainians can receive payments on preferential terms. The Main Directorate of the Pension Fund of Ukraine in the Donetsk region talked about when this might be possible.
The right to receive an old-age pension on preferential terms is regulated by Part 2 of Art. Final Provisions of the Law of Ukraine “Compulsory State Pension Insurance” No. 114 and 1058-IV. The law defines the list of professions where working conditions pose a danger to the life and health of the worker as follows:
- List No. 1 – list of professions with particularly harmful and particularly difficult working conditions;
- List No. 2 is a list of professions with harmful and difficult working conditions.
Hazardous professions include professionals working in mining, metallurgy, chemical industries, as well as some healthcare workers, transport workers and those involved in nuclear energy and radiation.
At what age do workers on List No. 1 retire (especially harmful and difficult working conditions)
If a person has worked full-time at any time in his working life in a hazardous industry where working conditions are particularly harmful and difficult, he can retire at the age of 50 if he has sufficient insurance experience:
- men – 25 years of experience, including at least 10 years in hazardous work;
- women – 20 years of experience, including at least 7.5 years in hazardous work.
If the total length of service is sufficient, but there is not enough experience in hazardous work, a person can retire on preferential terms, provided that at least half of the period of preferential service is present (for men from the age of 5, for women -). at least 3 years and 9 months).
In this case, the retirement period is determined by reducing the established basic retirement age in proportion to the length of service:
- for men – 1 year per year of work in hazardous production;
- for women – 1 year and 4 months for each year of such work.
At what age do workers on List No. 2 retire (harmful and difficult working conditions)
Preferential retirement opportunity is provided to employees in the profession specified in List No. 2 at the age of 55.
To do this, the following amount of insurance experience is required:
- men – a total of 30 years of experience, of which at least 12.5 years must be in hazardous work;
- women – a total of 25 years of experience, with at least 10 years in hazardous work.
If there is not enough experience in hazardous work, but at least half is available (for men – from 6 years and 3 months, for women – at least 5 years), the retirement age is reduced from the basic age as follows:
- for men – 1 year for every 2.5 years of hard work;
- for women – 1 year for every 2 years of such work.
Conditions for the appointment of old-age pension on preferential terms
In order for work experience in hazardous work to be taken into account when granting a pension on preferential terms, the enterprise must be certified according to the working conditions of its workplaces. This certification is done every five years.
If for some reason an organization or organization has not passed the certification, the period of special service will not be taken into account when calculating the pension.
When submitting documents for a pension to the Pension Fund, in addition to the usual list of documents, you must also submit documents confirming that the workplace has harmful and difficult or especially harmful and especially difficult working conditions.
An exception is the length of service obtained in hazardous and difficult work before August 21, 1992. It is counted without supporting documents regarding the certification of the workplace.
If the enterprise for which the preferential period of service was obtained is located in temporarily occupied territories or zones of hostilities, the right to receive a pension on preferential terms is confirmed if data on such period of service are included in the general state register of insured persons. .
Additionally, the preferential period of service can also be verified by a descriptive certificate from the organization or its legal successor. In case of liquidation of the enterprise, such experiences are verified by a special commission in the Pension Fund of Ukraine.
The certificate must state:
- working periods considered as preferential service;
- occupation or position in hazardous or difficult production;
- the nature of the work performed;
- a link to the indication of such work in lists of professions for which preferential length of service is provided;
- Available primary documents regarding the period of preferential service for which the certificate was issued.
