Writing to your employer can be the first step in protecting your workers’ rights. You have the right to express your complaints, request an explanation or demand payment of your salary.
Labor laws regulate the relationship between employers and employees, providing protection to both parties. These are among the most important human rights. Experts of the Main Directorate of the Pension Fund of Ukraine in the Kiev region told what to do in case your labor rights are violated.
PFU advises you not to accept violations of the rights and terms of the employment contract by the employer, since declared labor is your future.
how to behave
If the employer does not comply with the terms of the employment contract, a Ukrainian citizen can:
- Apply to the employer with a written request to eliminate violations and fulfill the terms of the employment contract.
- Contact your union body if you are a member of a trade union organization for help and support.
- Contact the Labor Disputes Commission (LCC), the primary mandatory body for the resolution of labor disputes. CTS is elected by the general meeting of the workers’ collective, which has at least 15 employees.
- Submit a written complaint to the State Labor Service of Ukraine for advice and assistance. Before filing a complaint, the employee should attempt to resolve the dispute directly at the business.
- To file a lawsuit to determine that the employer has violated the terms of the employment contract and to demand the return of violated rights and compensation for moral and material damage.
Labor disputes between the employee and the employer can be resolved through mediation.
The mediation agreement and the agreement regarding the results of mediation in labor disputes are made in writing.
